Extension of Regional Center Statute

It still appears that Congress will extend the current EB-5 Regional Center statute, which expires on September 30, 2016. Congress will do so via a continuing resolution that will extend the statute to December 9th. This resolution may pass around September 30th or shortly thereafter, but it will be effective September 30th. In late November or early December, the statute may be further extended with substantial changes, or possibly extended in its current form. Note that the non-Regional Center, “direct investment” part of the EB-5 law does not expire. However, a new EB-5 law may also change the rules for the direct EB-5 program as well. For example, the TEA rules may change and the investment amount may be increased for both the direct and Regional Center EB-5 programs.
